Fred "Jack" Holcomb, now 93. Holcomb founded Berjac of Oregon and Pacific Continental Bank in Eugene. Holcomb's sons took over Berjac in the 1990s, and the company slid into bankruptcy last year.
Eleven victims of Berjac's bankruptcy filed a class-action lawsuit against its founder, its accounting firm and two of Oregon's largest banks, alleging they aided in a Ponzi scheme orchestrated by the Eugene-based insurance-premium finance company and its owners.

The lawsuit, which seeks class-action status, names as defendants Portland-based Umpqua Bank, Eugene-based Pacific Continental Bank and Oregon accounting firm Jones & Roth. It also names Berjac founder Fred "Jack" Holcomb, the Holcomb Family Limited Partnership and the Holcomb Family Trust. It seeks more than $10 million in damages.

It's the first time Berjac's $46 million bankruptcy has legally snared Fred Holcomb, 93, a member of the Oregon Bankers Hall of Fame and a longtime Eugene businessman. He founded Berjac in 1963 and ran it for years before turning it over to his sons, Michael and Gary Holcomb, who led it into bankruptcy last year.

He also co-founded Pacific Continental, and his son Michael had served for years on Pacific Continental's board until Berjac's bankruptcy.

"Without the banks and Jones & Roth, Berjac of Oregon and Berajc of Portland could not have maintained their Ponzi scheme," said the complaint, filed Friday in Multnomah County Circuit Court in Portland by attorneys Michael Esler and Michael Haglund.

Umpqua's general counsel Steven Philpott declined to discuss the bank's relationship with Berjac, but called the lawsuit "another chapter in the continuing saga of class-action shakedowns."

"Our relationship with Berjac terminated over four years ago," he said. "This is old, old business."

Pacific Continental, in a press release, declined to discuss the case but said it took the matter seriously.

"While we intend to vigorously defend against this lawsuit, we remain unwavering in our 40-year plus commitment to our clients, employees, shareholders and community partners," bank CEO Hal Brown said.

Jones & Roth and an attorney for Holcomb did not immediately return messages seeking comment.

The lawsuit claims Berjac's "safe and secure" insurance-premium financing business was a front for a speculative real estate investments that benefited the Holcomb family for years. It alleges that little investor money went to Berjac's insurance-premium financing business, which declined throughout the years and brought in only $1.3 million annually at the time of bankruptcy.


Umpqua Bank and Century Bank, acquired last year by Pacific Continental, loaned money to Berjac and to other entities controlled by the Holcomb family, which then funneled the money to Berajc, the complaint alleges.

Internal bank records show that the banks knew of the speculative real estate investments, the lawsuit alleges, and that older investors were being paid with money from new investors, a sign of a Ponzi scheme.

The lawsuit alleges the defendants violated state securities laws and seeks to represent more than 400 investors sold Berjac notes since 1992. Both of Fred


Holcomb's sons are now in personal involuntary bankruptcies.

Philpott said banks shouldn't be held responsible for the wrongdoing of its customers.

"We had zero relationship with the plaintiffs who are the members of the class action," he said. "They are actually folks who loaned money to our former customer."

The Federal Bureau of Investigation has interviewed Berjac victims as part of its criminal investigation into the bankruptcy, investors say. The Internal Revenue Service also is investigating. State securities regulators fined Berjac of Oregon and Berjac of Portland $900,000 a day before they merged and filed for bankruptcy.

Betty Louise Davis was born in Ohio March 3, 1920. She passed away on February 5, 2014. She spent her youth attending grade school in Mills City, Oregon and graduated from Woodburn High School. She went on to attend Linfield College. She married Fred (Jack) Holcomb on June 13, 1942 and this year would have marked their 72nd anniversary. As a Navy wife for 24 years, she became well-versed in moving every two years throughout the West Coast, Gulf and Eastern shores of the US-wherever her husband was stationed. She and Jack spent many winters in New Zealand. Since Jack's retirement they visited most of Africa, Asia, Europe, Latin America and she had a life-long enjoyment of the Oregon Coast.

Betty was an avid golfer and was the first in the family to have a hole-in-one.

She was a survivor of the 1989 Honolulu-New Zealand flight accident in which the cargo door unlatched and several other passenger lives were lost.

Betty had a great love of animals of all sorts but especially for dogs and birds. She also greatly enjoyed spending time with her family, children, grandchildren and great-grandchildren. Betty is survived by her husband Jack; her two sons, Michael (Nancy) of Junction City and Gary of Eugene her five grandchildren, Jennifer (Mike) Chalmers, Kristen van Breemen, Emily Holcomb. Grant (Justina) Holcomb and Andrew Holcomb; and her 5 great-grandchildren; and numerous other extended family and dear friends.

A memorial service will be held at Spencer Creek Lutheran Church, 86286 Pine Grove Road, Eugene on Sunday, February,16th at 3:00 PM.

In lieu of flowers donations may be made to the Oregon Air & Space Museum.

Alice Clark1

     Alice was raised in the home of her grandparents, Ralsamond and Dorothy Bates (Holcombe) Clark. She early appreciated the several branches of Holcombes from whom she was descended as did her mother, Ellen.

They lived together until Ellen's death, at advanced age, who inculcated into the daughter, Alice, and together into the grand daughter, Clara Jane, enough appreciation of the importance of records and documents of the history of their branches of descendants of their several Holcombe ancestors to enable Clara Jane to continue the accumulation.

McPherson acknowledged their contribution in her book.

Alice maintained her own home in later years in Welland, Ontario, Canada; becoming blind and a helpless sufferer of arthritis. Alice Clark was born on 23 June 1851. She was the daughter of Ralsamon Aaron Clark and Ellen Holcombe. Alice Clark married Chapin Van Rensselaer Holcombe, son of Drayton Holcombe and Julia Ann Beam, in June 1872 at Greenville, Mercer Co., PA. Alice Clark died on 7 November 1923 at Welland Co., Ontario, Canada, at age 72.
